Chapter 03 - Just an Accident

Detective Okafor pulled the privacy curtain around Chloe's bed.

A cart rattled past, and a newborn cried somewhere down the hall.

Daniel stayed beside the window.

He had removed his tie, though the rest of him still looked ready for court.

Okafor clicked her pen.

"Start with where you were standing."

Chloe kept one hand on the monitor strap across her abdomen.

"Middle landing. Near the right rail if you're facing the street."

"Ms. Cross was above you?"

"Two steps."

"And Mr. Bennett?"

"Behind her. Maybe three feet."

Okafor wrote.

"What was said?"

Chloe repeated the exchange exactly.

She repeated the words in order, without improving her own part.

When she reached the shove, the detective stopped writing.

"Both hands?"

"Yes."

"Open palms?"

"I think so."

"You think?"

"I saw her shoulders move. Then her hands hit here."

Chloe touched the upper part of her chest.

"After that, I was falling."

"Did you touch Ms. Cross first?"

"No."

"Grab her clothing?"

"No."

"Threaten her?"

"No."

"Call her pathetic?"

Chloe paused.

"I said I hoped Ethan loved her because it would make the situation less pathetic."

Daniel lowered his eyes to hide something that might have been approval.

Okafor's mouth barely moved.

"All right."

She turned a page.

"Ms. Cross says you stepped backward while agitated. She says she reached to steady you."

"With enough force to send me down fourteen steps."

"She says your hand caught her coat."

"Her coat was buttoned. I never touched it."

Okafor nodded once.

"Mr. Bennett says he saw Ms. Cross extend her arms, but he couldn't tell whether she pushed or tried to catch you."

The baby kicked beneath Chloe's palm.

"He's lying."

The words came out without heat.

Okafor watched her.

"Why would he?"

"Because he's sleeping with her."

"That makes him disloyal. It doesn't automatically make him a witness to assault."

"No. Standing there and watching made him a witness."

The detective closed her notebook halfway.

"Mrs. Bennett, I believe you fell. I believe Ms. Cross made contact with you."

Okafor tapped the pen against her notebook.

"Intent is the part I have to establish."

Daniel finally spoke.

"Ms. Cross followed her from a closed mediation onto wet stairs, then put both hands on her chest."

"I need more than your summary before requesting felony charges," Okafor said.

"Then get more."

"I plan to."

Okafor did not look away. Chloe trusted that more than easy sympathy.

Okafor faced Chloe again.

"Did anyone record it?"

"I don't know."

"There were bystanders."

"A man near the curb had a phone."

"Using it or filming?"

"Using it before I fell. I don't know after."

Okafor reopened the notebook.

"Anything else?"

Chloe saw the staircase again.

Vivian's handbag. The blue folder. Ethan's face after Chloe landed.

"He didn't come down."

"Who?"

"Ethan."

Okafor waited.

"He stood at the top with Vivian. Daniel reached me first, and Daniel was inside the building."

The detective wrote that down.

After Okafor left, Poppy's heartbeat continued in quick mechanical beats.

Daniel handed Chloe water.

"You did well."

"This isn't a deposition."

"Occupational damage."

"Ethan lied for her."

"Yes."

"He didn't even come down."

Daniel sat.

"Chloe."

"No, I know what you're going to say."

"What am I going to say?"

"That I shouldn't decide anything while I'm injured."

"You already filed for divorce."

"I mean about him as a person."

"You decided that before today. You're only grieving the version you hoped was still hiding underneath."

Six years of marriage did not disappear cleanly. It left coffee cups chosen together, private jokes, and a dent where Ethan had carried in their first sofa.

She remembered him assembling the crib without instructions, laughing when she teased him about the extra screws.

That man existed.

So did the one at the top of the steps.

Chloe touched her locket, then flinched when her thumb found the cracked glass.

"Can it be fixed?"

Daniel looked at it on the bedside table.

"The chain, yes. The glass, probably."

"The picture?"

"It's fine."

She nodded.

Ethan arrived just after nine that night.

He brought tulips from the gift shop and waited in the doorway.

Daniel rose from the chair.

"No."

"I need to see my wife."

"Your wife is resting."

"She's carrying my daughter."

Daniel's expression stayed neutral.

"You remembered."

Chloe turned her head.

"Let him in."

Daniel looked at her.

"I want to hear what he says."

Ethan entered. "Is she okay?"

"Dr. Reyes says the placenta was strained. They're watching for early labor."

Ethan's face folded for one second.

"God, Chloe."

He stepped toward the bed.

Daniel moved half a pace, enough to stop him.

Ethan looked at him.

"I'm not going to hurt her."

"You had an opportunity to demonstrate that."

"Daniel, please."

"No. Talk to her."

"It happened so fast."

Chloe watched him carefully.

"What happened?"

"Vivian reached for you. You slipped."

"Is that what you saw?"

"I saw her hands go out."

"Did they touch me?"

"I couldn't tell."

"You were three feet away."

"People were moving. It was raining."

"The rain had stopped."

Ethan glanced at Daniel.

"This is why I wanted to talk alone."

Chloe's fingers moved toward her wedding ring.

She stopped them before the first turn.

"Why didn't you come down the stairs?"

Ethan's mouth opened.

"I was in shock."

"So was Vivian."

"Yes."

"She covered her mouth. You touched her shoulder."

He stared.

"You remember that?"

"I remember everything until I hit the bottom."

Ethan sat in the chair without being asked.

"I never wanted this."

"You brought her to my divorce mediation."

"She insisted."

"You let her follow me."

"I told her to stop."

"You lied to the police."

His voice sharpened.

"I didn't lie."

"You said you couldn't see."

"I couldn't."

Chloe went very still.

Ethan mistook it for fatigue.

"I know you're upset. We'll handle the medical bills. Vivian feels terrible."

"She feels terrible," Chloe repeated.

"She didn't mean for you to fall."

"Did she tell you that?"

"She was hysterical."

"That isn't an answer."

Ethan looked at the flowers.

"Her lawyer told her not to contact you."

"Good advice."

"Chloe, if you call this an accident, maybe we can keep it from becoming... bigger."

Daniel faced him.

"Leave."

Ethan stood.

"I was talking to my wife."

"No. You were asking an injured witness to change her statement."

"That's not what I said."

"It's exactly what you said."

Ethan's cheeks flushed.

Chloe looked at the tulips, their stems cut unevenly and trapped inside a narrow plastic sleeve.

"Take those with you."

He stared at her.

"Chloe."

"Take them."

Ethan grabbed the flowers and left.

Daniel shut the door.

"That was useful."

"He came to protect her."

"He came to protect himself."

Chloe looked toward the monitor.

"How do we prove what happened if everyone says the angle was bad?"

Daniel stood near the bed, thinking.

His eyes shifted toward the hospital television mounted high in the corner. The screen was black, reflecting the room in a dark rectangle.

""Public building," he said. "The courthouse entrance."

Chloe remembered the black dome above the exterior arch.

"There was a camera."

"At least three," Daniel said.

He made three calls. Before ten fifteen, a preservation request had been sent.

Detective Okafor called back.

"The district attorney's office already requested the exterior footage," she said through the speaker. "Security says release could take several weeks because it may be evidence in a pending case."

Daniel's jaw tightened.

"Weeks?"

"Unless a judge orders expedited production."

Chloe looked at the monitor paper curling toward the floor.

Vivian had a story.

Ethan had chosen it.
