Chapter 10 - Charges Filed

Vivian surrendered through the side entrance of the county criminal courthouse at eight twelve the next morning.

Her attorney negotiated the timing to avoid cameras, but a photographer caught her stepping from a black SUV. By nine, the image sat beside the courthouse footage online.

Chloe saw it on Daniel's kitchen television while eating oatmeal.

Daniel stood at the counter grinding coffee.

"Don't watch."

"I turned off the sound."

"Pictures count."

"So do facts."

Chloe touched the cracked locket at her collarbone.

"Will she be held?"

"Probably not. No prior convictions, local address, counsel arranged surrender."

"Can she contact Ethan?"

"Unless the court restricts it."

"Can she contact me?"

"That will be prohibited."

Daniel poured water into the coffee maker.

"Her arraignment is at eleven. You don't need to attend."

"I know."

"You shouldn't."

"I know."

He looked over his shoulder.

"Are you agreeing or ignoring me politely?"

"Both."

Dr. Reyes had cleared Chloe for limited activity if the next monitoring appointment remained normal. Chloe had promised not to enter the courthouse that day.

She kept that promise.

Instead, she went to Daniel's office, where Lena had arranged a private video feed from the public courtroom stream.

Vivian appeared on-screen beside her attorney.

Without the cream coat and hard lipstick, she looked younger. Tired. Her hair was pulled into a low knot, and the skin around her eyes had the dull gray cast of someone who had not slept.

Vivian pleaded not guilty.

Her attorney called it brief physical contact during an emotional family dispute and emphasized that she remained at the scene.

Daniel wrote: *Remained with Ethan.*

The prosecutor described the shove, pregnancy, medical risk, and delay before anyone sought help.

Vivian looked down. Horror did not erase the hands.

The judge released Vivian on bond, prohibited witness contact, and ordered her passport surrendered.

"That's it?" Chloe asked.

"For today," Lena said.

Daniel closed the stream.

"Criminal cases are made from small rooms and delayed dates. Television lies about the speed."

His phone rang.

He checked the number and answered.

"This is Daniel Bennett."

A woman's voice spoke quickly through the receiver.

"Send it in writing."

He listened.

"No. Do not summarize it. Exact words, exact time, and everyone present."

Chloe set down her tea.

When he ended the call, Daniel remained standing.

"That was Assistant State's Attorney Myers."

"What happened?"

"Vivian asked to speak with investigators after arraignment."

"Without her lawyer?"

"Her lawyer was present."

Lena pulled a chair closer.

"What did she say?"

Daniel looked at Chloe.

"She says Ethan told her to confront you."

The room went still.

Chloe's first response was oddly practical.

"He told her when?"

"She claims the morning of mediation."

"What words?"

"Ethan said you needed to be scared into settling before you found the money."

Lena swore under her breath.

Chloe turned her wedding ring once.

"This is a deal offer."

"Not formally," Daniel said. "It's panic."

"Does she claim he told her to push me?"

"No. She says he told her to make a scene, tell you he would fight custody, and convince you the stress could hurt the baby."

Chloe's fingers stopped on the ring.

"He used the baby."

"That's her claim."

"She knew about the money."

"Apparently."

Lena opened her laptop.

"Did Ethan tell her where it went?"

"Vivian says he described the transfers as protection from an unfair divorce."

Chloe walked toward the windows. Taxis moved below in short yellow bursts.

"Ethan came to your office after the emergency motion," she said.

"Yes."

"He admitted moving the money because he knew I'd freeze it."

"Yes."

"He also knew Vivian was afraid of charges."

Daniel joined her near the window.

"Yes."

"What if the visit wasn't only about getting me to soften my statement?"

"What else?"

"He may have been checking what I knew before deciding whether to keep paying for her lawyer."

Lena looked up.

"Her attorney is expensive."

"Who retained him?" Chloe asked.

Daniel reached for his phone.

"We'll find out."

The answer came before lunch.

Vivian's criminal retainer had been paid from a consulting company called Northline Strategic Holdings.

Lena traced Northline to an address shared with Ethan's employer's outside payroll vendor. Its listed manager was a former college roommate of Ethan's.

The payment had been wired forty minutes after the courthouse fall.

Chloe read the transfer confirmation.

"He hired her lawyer before he called the hospital."

Daniel checked the hospital records.

Ethan's first call to the maternity floor came at four sixteen.

The wire had cleared at three thirty-one.

"He called the firm from the courthouse," Lena said.

"Or from the police interview room," Daniel replied.

Chloe looked at the amount.

Twenty-five thousand dollars.

More than Ethan had spent preparing for Poppy's arrival. More than Chloe's school received for the entire art department in one year.

"Marital funds?" she asked.

"Likely routed from the missing account," Daniel said.

Chloe remembered the blue folder in Vivian's open bag.

Bryce enhanced the label. Three characters appeared: N-S-H.

Northline Strategic Holdings.

Vivian had carried its financial folder into the courthouse.

"She wasn't only there for emotional support," Chloe said.

"No."

"She knew the shell company."

"At minimum, she had documents bearing its initials."

Daniel's voice became very quiet.

Chloe recognized it as the voice he used when an opposing witness handed him the missing piece without realizing it.

"Get a preservation order for Northline," she said.

"Already drafting."

"Subpoena the roommate."

"Already on Lena's list."

Chloe looked at the photograph again.

Vivian had come carrying paperwork for the company holding their money.

They wanted Chloe to sign before she understood what had been removed.

Ethan called that afternoon through his attorney.

He offered fifteen thousand dollars, medical expenses, and support if Chloe stopped "advocating for expanded criminal theories."

Daniel read the proposal aloud once.

Then he placed it on the table.

"That's not a settlement," Chloe said.

"No."

"It's a price."

"A low one."

She turned her ring a second time.

"Respond with full restitution, sworn accounting, and preservation of every device."

Daniel picked up his pen.

"Anything else?"

"Yes."

Chloe looked at the cracked locket.

"Tell him I won't make any agreement concerning criminal evidence."

Daniel wrote.

"Good."

"Don't add adjectives."

"I never add adjectives."

"You called opposing conduct predatory in the nursing-home case."

"It was."

"Still an adjective."

Lena hid a smile behind her hand.

They drafted a plain response with no threats, only requests they could defend in court.

Detective Okafor arrived at four with a folder under her arm and snow melting on the shoulders of her coat.

She closed the conference-room door.

"Vivian's statement creates possibilities, not proof."

Daniel handed her the Northline wire.

"This helps."

Okafor read the document, then the enhanced still.

"Where did you get the payment record?"

"Lawfully."

"That answer is why detectives dislike trial lawyers."

"Do you want the chain of custody or not?"

"I want it without the speech."

Chloe sat across from her.

"Do you believe Vivian?"

Okafor took off her coat.

"I believe she has a reason to reduce her own responsibility."

"That wasn't my question."

The detective looked at her.

"I believe Ethan encouraged the confrontation. I don't yet know whether he intended physical harm."

"What would prove it?"

"Messages. Recorded calls. Financial promises tied to your settlement."

Daniel tapped the Northline paper.

"Start with the roommate."

"Already requested an interview."

Okafor opened her folder.

"There's more. Vivian turned over selected messages."

She placed screenshots from the morning of mediation on the table.

*She needs pressure. Not another gentle conversation.*

*Mention the house. Mention custody if you have to.*

*Say you tried to catch her. Do not call me until counsel contacts you.*

Chloe read each message twice.

Pressure.

Custody.

Say you tried to catch her.

Daniel did not touch the pages.

"Authenticated?"

"Preliminary extraction from Vivian's phone. We have a warrant request for Ethan's."

"Any reply from her before the assault?"

Okafor turned over another page.

Vivian had written:

*She won't listen to me.*

Ethan answered:

*Then make her.*

Chloe's hand moved to her stomach.

Poppy pressed back.

Ethan might call the shove Vivian's choice, but he supplied the pressure and the lie afterward.

"He knew what story she should tell before police interviewed them," Chloe said.

Okafor nodded.

"That's the strongest part for obstruction."

"And intimidation?"

"Potentially."

Daniel stood.

"We amend the civil complaint. Intentional infliction, conspiracy, fraudulent transfer."

"Don't outrun the criminal case," Okafor said.

"I'm not."

"You look like you are."

"I look like this all the time."

Chloe kept reading the messages.

For four months, she had described Ethan as weak.

Weak enough to cheat. Weak enough to lie. Weak enough to stand still after she fell.

The word had protected one small part of her from a worse conclusion.

Weakness suggested drift.

These messages showed direction.

Daniel placed both palms on the table.

"He's not just weak."
